The 7-Point Checklist Before Your Disciplinary Hearing
You have been handed a notice, and the hearing is in a few days. Before you walk into that room, there are seven things worth checking. Each one is part of what South African law treats as a fair process, and each one is a question you are entitled to ask.
We have put them into a free two-page checklist you can print, tick off, and take with you on the day. It is grounded in the Labour Relations Act and Schedule 8, the Code of Good Practice: Dismissal.
What is inside
- The charges in writing, and what a proper charge sheet must actually tell you
- Reasonable time to prepare, why a same-day hearing is a red flag, and how to ask for more time
- Who may sit beside you, and the rules on representation in an internal hearing
- The employer’s evidence, what to request before the day, and what to do if it appears mid-hearing
- Your own evidence and questions, how to build a timeline and question a witness without making a speech
- An impartial chairperson, plus interpreters, written reasons and the internal appeal
- Your 30-day CCMA clock, how it is counted, and the mistake that puts people out of time
Plus three things people commonly get wrong, and a short list of what to take with you on the day.

Sentinel Labour Consulting is a labour consultancy, not a law firm. We help employees prepare for disciplinary hearings, and help employers run processes that hold up to scrutiny. We do not provide legal representation at hearings, the CCMA, bargaining councils or the Labour Court, and this checklist is general information, not legal advice.
